Brewster Man Faces Misdemeanor Charges

Putnam County Sheriff Donald B. Smith reports the recent arrest of a Brewster man on a variety of misdemeanor charges during a traffic stop.

On January 15, 2012 at 11:06 a.m., Deputy Sheriff Scott Lombardo stopped a motorist who had committed a traffic violation on Route 6 in the Village of Brewster. The deputy determined that the driver, identified as Abelino C. Hernandez, 21, of 108 Oak Street, Brewster was unlicensed to operate a motor vehicle in the State of New York. The deputy advised Mr. Hernandez to step out of the vehicle, because he could not allow Mr. Hernandez to continue to drive. As Mr. Hernandez exited the vehicle, the deputy observed an item in the man’s pocket that appeared to be a weapon. As the deputy began to pat down the man’s clothing, Mr. Hernandez physically resisted the deputy. The deputy recovered a knife from the man’s pocket. The deputy arrested Mr. Hernandez and charged him with Obstructing Governmental Administration in the Second Degree, Criminal Possession of a Weapon in the Fourth Degree, and Resisting Arrest, misdemeanors. The defendant was arraigned on the charges and committed to the Putnam County Correctional Facility pending a future appearance in the Village of Brewster Justice Court.

If found guilty of the misdemeanor charges, the defendant could face up to a year in jail and a fine of up to $1,000.00 for each charge.
